SET UP A SPECIAL COURT FOR NON- STOP KUMARASWAMY V/S YEDURAPPA ALLEGATIONS

The Feud between H. D. Kumaraswamy and B. S. Yeddyurappa has reached a ridiculous level. Kumaraswamy sat on a ‘fast unto death’ demanding CBI probe into the charges made by Yedurappa against himself (Kumaraswamy) and family. The fast ended abruptly over his health and pressure from his party JD(S). And Yedurappa had made it clear that he will not order a CBI probe under any circumstances.

Earlier, Yedurappa had thundered that he will file defamation cases against Kumaraswamy and also opposition leader Siddaramaiah for their exposure over Ratna Cement Scam. It was clear that Yedurappa who blocked every attempt at investigations into his scams was to silence Kumaraswamy through defamation case, but some how, the threat did not materialise.

Then, Kumaraswamy after his futile “fast unto death”, made a statement that he will be filing a defamation case against Yedurappa, State BJP President K. S. Eswarappa, national BJP spokesperson Nirmala Seetharam for their releasing the ‘charge sheet’, a compilation of the scams of H. D. Deve Gowda family.

When Kumaraswamy made serious charges against Yedurappa, his kith and kin and some Ministers, he tried to take the scams at a logical end. Complaints were filed against Yedurappa and company in the Lokayukta and Yedurappa in his bid to block Lokayukta probe, constituted a judicial commission to probe the denotifications since the period of Deve Gowda. Later he got a set up person to approach the High Court for clarification about the probe agency - Lokayukta or Judicial commission. The petition in the High Court is since eight months and the matter is yet to be decided. Even though the High Court has not stayed the Lokayukta probe, the Lokayukta did not proceed with the probe and prefered to wait till High Court clarification. The High Court had stayed the proceedings of the judicial commission.

Yedurappa in order to save himself from various probes and cases blocked all the attempts at probing his scams. After ensuring the same, Yedurappa turned his attention to ‘finish off’ Kumaraswamy politically. He started hurling allegations against Deve Gowda family and accused them of indulging in scams themselves.

Kumaraswamy and even Deve Gowda family challenged Yedurappa to take action over the alleged scams as Yedurappa had the authority and the entire Government machinery at his disposal. But despite the best efforts of Yedurappa and his followers to discredit Kumaraswamy, they did not get the desired result of silencing Kumaraswamy. Yedurappa in fact gave a clarion call to his party and even Congress to finish off the JD(S) and the dominance of Deve Gowda family.

Finding that he could not discredit the Deve Gowda family, Yedurappa tried to patch up with Kumaraswamy through his loyal wheeler - dealer. When the matter was leaked by Kumaraswamy, Yedurappa to save his image challenged Kumaraswamy to appear before Lord Manjunatha of Dharmasthala and swear before him that he had tried to patch up with him and he too will swear likewise. However, at the eleventh hour Yedurappa backed out from the swearing ceremony while Kumaraswamy went ahead and did the swearing. In the process Yedurappa lost his face. To salvage his sullied image, Yedurappa in a desperate bid, compiled the charges against Deve Gowda family in a booklet titled ‘Charge Sheet’. The reaction from the Deve Gowda, the subsequent fast etc. need not be repeated.

Kumaraswamy has now threatened with defamation case against Yedurappa and others including the Rastrothana Printing Press owned by RSS, which printed the charge sheet.

Even if Kumaraswamy files the defamation case, it is sure to take years on end to decide the matter. Given the expertise of Yedurappa in dragging the cases, sometimes blocking the same, the case may be dragged for decades! The cases are time consuming and test the patience of the people concerned.

As on now, both Yedurappa and his party have leveled serious charges against Deve Gowda family and Kumaraswamy has exposed very serious scams of Yedurappa and his Ministers. The people have a right to know the truth. It is in the interest of decency in politics, that the Government set up an exclusive court to conduct the trial over the charges and counter charges made by Yedurappa and Kumaraswamy. The trial should be conducted on a day to day basis and before forming the special court, Yedurappa should withdraw all his legal challenges in the High Court against the trial.

If a special court is formed, one can be sure of the trial coming to an end in a matter of one year. This will also end multiple probes into the charges by various agencies. And that indeed is a sensible solution!
